Agreement on the Transfer of Copyright

(General Terms for Publication In International and Comparative Law Review)

I. Parties to the Agreement

  1. Publisher: Univerzita Palackého v Olomouci, Právnická fakulta, tř. 17. listopadu 8, 771 11, Olomouc, Česká republika.

  1. Author:

The individual or group of individuals submitting their work for publication. In the case of multiple authors, they are referred to collectively as the "Author."

 

II. General Provisions

  1. By submitting a scientific article, discussion paper, or review (hereinafter “Article”) to the International and Comparative Law Review (hereinafter “Journal”), the Author agrees fully and irrevocably to the terms of this agreement. The Author may revoke this agreement only prior to acceptance of the Article.
  2. This agreement becomes effective once the Article is published in the Journal.
  3. The Editor-in-Chief and Executive Editor, as representatives of the Publisher, manage the editorial process and confirm acceptance of the Article.
  4. Acceptance is confirmed electronically, typically via email. The Author must acknowledge receipt of acceptance promptly.

III. Grant of Rights

  1. The Author grants the Publisher the following rights to the Article and any supplemental materials:
  2. To publish, distribute, transmit, and otherwise use the Article in electronic and print formats, in all forms and media, worldwide, and in all languages.
  3. To provide the Article in electronic and online platforms.
  4. These rights are exclusive, free of charge, and granted for the full term of copyright, without geographical limitation. The Author retains rights outlined in Article V.
  5. The Publisher may transfer or license these rights to third parties.
  6. The Author also grants the Publisher the right to exploit the Article through current and future forms of media, including granting licenses to third parties, for free or for remuneration.

IV. Author’s Warranties

  1. The Author confirms and guarantees that:
    • The Article is original and has not been published elsewhere.
    • The Article is not under consideration for publication in another journal.
    • All authors and their contributions are disclosed, ensuring compliance with anti-ghostwriting policies.
    • Sources of funding are acknowledged in the Article.
    • The Author has adhered to academic and publication ethics.
    • Permissions for copyrighted material are obtained and appropriately credited.
    • Co-authors, if any, are aware of and consent to the terms of this agreement.
    • The Article contains no defamatory, unlawful, or rights-infringing material.

V. Retained Rights of the Author

  1. The Author retains the right to:
    • Make copies of the Article for personal use or teaching purposes.
    • Share copies with research colleagues for personal use.
    • Present the Article at conferences and distribute copies to attendees.
    • Retain patent and trademark rights related to the Article.
    • Include the Article in theses, dissertations, or collected works, with acknowledgment of its original publication.
    • Use portions or excerpts in other works, provided proper attribution is given.

 

VI. Publisher's Rights to Reject or Withdraw the Article

  1. The Publisher reserves the right to reject the Article if it:
    • Fails to meet copyright standards.
    • Does not meet the Journal’s formal requirements.
    • Contains inaccuracies or lacks sufficient explanation.
    • Shows significant editorial or ethical deficiencies.
  2. If deficiencies are identified, the Publisher may:
    • Extend the revision period.
    • Accept the Article after corrections are made.
    • Withdraw from the agreement if deficiencies are not resolved within the specified timeframe.
  3. If the Article is rejected, all granted rights revert to the Author.

 

VII. Online Access and Licensing

  1. The Journal may be made available online via the Publisher’s website or other platforms.
  2. Articles may be published under a Creative Commons Attribution-NonCommercial-NoDerivatives (CC BY-NC-ND) license or similar, ensuring non-commercial sharing with proper attribution.
  3. The Publisher may display the Author’s details, including:
    • Name, academic titles, and positions.
    • Affiliations at the time of submission.
    • Contact information, such as email addresses and research identifiers (e.g., ORCID, Scopus Author ID).

VIII. Governing Law and Dispute Resolution

  1. Matters not addressed in this agreement are governed by Czech copyright and related laws.
  2. Any disputes will be resolved by the courts of the Czech Republic.

IX. Additional Provisions

1. This agreement applies unless an individual contract between the Publisher and the Author states otherwise.
